Uttam Kumar, who murdered her former student Priyanka Garg, spared death penalty because of lack of evidence.

New Delhi: A man who murdered a student of Delhi St Stephen's College in 1999 because he could not marry her was on Thursday sentenced to life in prison.

Uttam Kumar, a private tutor, killed his former student Priyanka Garg ten days before her wedding. Additional Sessions Judge Bharat Parashar, who had found Kumar guilty on March 7, said the murder was brutal but the accused did not deserve death penalty because the case did not fall in the rarest-of-rare category.

"In the light of the over all circumstances of the case, coupled with the nature of the evidence led by the prosecution, this cannot be stated to be falling in the rarest-of-rare category," the judge said.

"I, considering the heinous, diabolic and brutal murder committed by Uttam Kumar, sentence him to rigorous imprisonment for the rest of his life," the Parashar said.

The court fined Kumar Rs 5 lakh, of which Rs 3 lakh will be given to Priyanka’s parents. Kumar stabbed Priyanka to death at her Adarsh Nagar residence on April 19, 1999 after he found that she was marrying.
