SC to hear plea for probe into Banda rape case

New Delhi: The Supreme Court on Monday admitted a petition by senior lawyer Harish Salve seeking a judicial inquiry into the alleged rape of a Dalit girl by Bahujan Samaj Party MLA Purushottam Dwivedi. The court will hear the petition on January 21.

The court will also look into the role of policemen who where involved in incarcerating the girl for four weeks in jail on charges of theft.

The girl was charged with committing theft at Dwivedi's house after she alleged rape by the MLA.

The girl has alleged that the MLA raped her on December 10-11, 2010, at the his residence. She escaped from the MLA's house on December 12 when the he allegedly attempted rape for the third time. She was arrested the same day on theft charges levelled against her by the MLA.

However, she was released on January 15 after the CB-CID claimed in its reports that theft charges against the girl were not true.

The 48-year-old Dwivedi, who represents Naraini seat in Uttar Pradesh Assembly was arrested on January 13 after he had been absconding for many days. He was sent to judicial custody till January 27 by the Banda chief judicial magistrate.

The MLA's two aides, Rajendra Shukla and Surendra Neta, have been arrested. But third accused, Ravan Garg, is still absconding.
