Bombay HC grants bail to Daya Nayak
Suspended Mumbai police sub-inspector Daya Nayak was on Thursday granted bail by the Bombay High Court in the disproportionate asset case.

Mumbai: The Bombay High Court on Thursday granted bail to encounter specialist Daya Nayak.

He was granted bail on technical grounds as the anti-corruption bureau had failed to file a chargesheet against him in the stipulated period of 60 days in disproportionate asset case.

Nayak, a suspended police sub-inspector who surrendered before police on February 20, is facing charges under the Prevention of Corruption Act for possessing assets disproportionate to his known sources of income.

After his arrest, he had been lodged in the Bhoiwada lock-up. Justice V M Kanade, while granting bail to Nayak, directed him to furnish a surety of Rs 25,000 and to attend the office of the ACB as and when required by them or twice a month, till the chargesheet is filed against him.

He has also been directed not to leave the country without the permission of the court.

Justice Kanade also held that since prosecution has failed to file a chargesheet in the stipulated period, the accused cannot be detained in custody for a prolonged period without any justified reason.
