New Delhi: The Supreme Court on Thursday ruled that all commercial activities must stop in the residential areas of Delhi within 30 days and directed the authorities to start the process of water and electricity disconnection in these 30 days.
The court also asked the MCD to publish within 10 days in newspapers the list of residential premises used for commercial purposes in the national capital in violation of the rules.
A Bench headed by Chief Justice Y K Sabharwal directed the owners of such premises to stop the misuse of the residential premises within 30 days of the publication of the list of major violators.
The court said the owners will have to file an affidavit within 30 days with the MCD commissioner that they have stopped the misuse of the premises.
The court made it clear that the sealing of the premises will begin after the expiry of the deadline after the publication of the list.
The court also said that the MCD will start its action against the major violators on priority.
The Bench also clarified that its order is limited only to the misusers of the residential complex and MCD will have to take action first in the areas where there has been major violations of the rules.
The Court left the small shops for the time-being. It said that if any tampering is done with the ceiling of the premises, appropriate action will be taken against the violators.
The court also directed the MCD Commissioner to file in two weeks on the action taken by the corporation.
