The Madras High Court, on Wednesday, admitted a Public Interest Litigation (PIL) filed by an ex-servicemen seeking prevention and ban on defacement of the national flag and commercially selling such defaced or modified versions of the tricolour.
The first bench comprising Chief Justice E Y Iqbal and A Arumugasami, asked the petitioner to implead appropriate parties in the litigation. The petitioner R Govindarajalu said the “defacement” violated Article 51 A of the Constitution and provisions of the Prevention of Insult to National Hounour Act, 1971 and prayed for banning such defacement .
