New Delhi: The Juvenile Justice Board hearing the case of a minor, who is accused in the December 16 gangrape of a paramedical student, has been asked to wait till the Supreme Court takes a decision on Janata Party chief Subramanian Swamy's petition to try him as an adult. Swamy tweeted that the apex court will hear his petition on August 14.
Swamy will also inform the Juvenile Justice Board that the case is pending in the Supreme Court and till the matter is disposed off by the apex court, no order should be passed.
The Janata Party chief had petitioned in the apex court, challenging the law fixing 18 as the age of juvenile.
Additional Solicitor General Siddharth Luthra told the apex court bench headed by Chief Justice P Sathasivam that he would accordingly instruct the public prosecutor to inform the Juvenile Justice Board that it should not pronounce its verdict which is scheduled for August 5.
The court also said that it will examine the maintainability of Swamy's petition as ASG Luthra contended that there could not be any third party intervention in a criminal matter involving a state and an individual.
The minor accused was 17 when the girl was brutally assaulted and gangraped inside a private bus in Delhi. She later died after battling for life for 13 days in a Singapore Hospital. He was declared a minor by the Juvenile Justice Board in January
Under the juvenile law, he can be sentenced for a maximum of only three years.
