Amid the ongoing probe into the deaths of UPSC Aspirants, a Delhi Court on Wednesday denied bail to Manoj Kathuria, an SUV driver and businessman by profession, arrested in connection with the deaths of three civil services aspirants who drowned in the basement of an IAS coaching centre in the city’s Old Rajinder Nagar area.

Kathuria has been accused of driving his Force Gurkha car through the street that was flooded by rainwater, causing the water to swell and breach the gates of the three-storey building and inundate the basement.

As per the order copy accessed by CNN-News18, the denial of bail to Kathuria came after the court said that the CCTV Footage shows that the accused can be seen driving the said vehicle on an already heavily waterlogged road at a high speed causing large displacement of water.

As a result of this, the gate of the alleged premises gave way and the water went into the basement, consequently claiming three innocent lives, the order copy further read.

The court also stated that the CCTV footage further shows that the driver was even warned of the potential dangers ahead by some passersby, which he did not pay any heed to.

As per the court’s observations, the allegations against the accused are serious in nature.

While speaking to the media, Kathuria’s wife Shima said, “We are very disappointed that the bail application has been rejected. We were very hopeful that Manuj would come back home tonight but he will have to spend another night in jail without any fault. The High Court Judge mentioned thrice about a passerby getting arrested. Sooner or later, we will get justice.”

During the hearing at the Tis Hazari court on Wednesday, Judicial Magistrate Vinod Kumar also denied bail to four co-owners of the basement, namely Parvinder Singh, Harvinder Singh, Sarabjit Singh and Tajinder Singh.

“All the bail applications are dismissed,” the judge said.

The four co-owners have been charged with abetting the offences. The five accused were arrested on Monday.

Earlier on Sunday, a magisterial court had sent to 14 days judicial custody Rau’s IAS Study Circle owner Abhishek Gupta and coordinator Deshpal Singh.

Police have registered an FIR under the Bharatiya Nyaya Sanhita (BNS) sections 105 (culpable homicide), 106(1) (death of any person by doing any rash or negligent act not amounting to culpable homicide), 115(2) (punishment for voluntarily causing hurt)and 290 (negligent conduct with respect to pulling down, repairing or constructing buildings).
