BANGALORE: The High Court admonished the state government for not producing the relevant documents related to the land acquisition for Aero Space Industrial Area project near Devanahalli on Friday.The government advocate submitted that the state conceived the project after three companies Dynamatic Aerospace Ltd, Shoba Nadathur Pvt Ltd and Black Hawk requested the government to give permission to set up an aero space related industries.Justice D V Shailendra Kumar asked the state government to justify how the notification to acquire 1,070 acres of land was given when the total requirement of all the three companies was just 45 acres.The court also demanded to know how the project was conceived and asked for the records of the preliminary notification and the objections filed by the land owners and the details of the final notification."How and to whom did you disburse Rs 370 crore from the public money without records?" Justice Kumar demanded.Stating that a fraud has been committed Justice Kumar said, "The government is not competent to provide food and shelter to needy in the state but it is offering electricity and water along with subsidies to the multinationals. If all the records are not placed on the record of the case the acquisition would be set aside unless the judge gets changed, such things do happen in High Court."Justice Kumar also added, "The government is acting like a greedy petty developer and has turned a predator, affecting the interests of the poor farmers to favour the multinationals. People with myopic vision file false and incorrect affidavits before the court to evade the consequences of their action. Now the court has to search if the project for which the land was existed really exists. This sort of a thing happens in a feudal set up or kingdoms and should not happen in the democracies that have written constitution."Justice Kumar adjourned the case to June 27 and observed that the government's repeated requests to grant time and withholding of information, despite fingers being pointed at it for violating the statutory power, gives rise to adverse inference.
