High Court orders the reinstatement of Army personnel discharged on medical grounds.

New Delhi: The Delhi High Court has ordered the reinstatement of 26,706 Army personnel who were discharged by the Indian Army Chief General Deepak Kapoor on medical grounds.

The High Court has ruled that all army personnel would also be entitled to back wages and benefits. All those reinstated can join their respective departments and units.

The landmark order was passed on Thursday by a single judge bench of Justice Sanjay Kishan Kaul . The Army has been given a one-month deadline of one month for the reinstatement of the discharged personnel.

The court has criticised the Army Chief for not referring to the army constitution, and not forming a "Invalidating Board" to review the termination.

In 2007, the Army chief had ordered the discharge of 26,706 army personnel on medical grounds like hypertension.

The court also said that the Army chief did not refer to the army constitution and discharged the personnel without constituting any committee to look into the matter.

The order was passed on a petition filed by Naib Subedar Vijay Kumar Dubedi through his counsel Siddharth Shankar Ray and Abhik Kumar.

Dubedi had alleged that the Army has discharged him and other many other personnel in violation of the rules and regulations for the medical services of armed forces.
