NEW DELHI: Jailed DMK MP Kanimozhi’s lawyer Altaf Ahmed invoked the special provision under Section 437 of the CrPc that allows bail to a woman accused under certain conditions. He also said the court could impose any condition to ensure the presence of the accused before the judge as and when required.Moreover, the accused should also be released on bail as the trial in the case will take time since it involves 154 witnesses, 17 accused and 790 documents running into more than one lakh pages. DMK chief M Karunanidhi’s daughter, Kanimozhi (43), has been in jail for about five months since her arrest on May 20.Meanwhile, CBI special public prosecutor UU Lalit continued to oppose the bail of other accused in the case. During arguments on Monday, he made his intention clear that bail for two other accused, Swan Telecom Promoter Shahid Balwa and former Telecom Minister A Raja’s private secretary R K Chandolia, would be opposed. He argued that one can make a distinction so far as those accused who face a maximum punishment of five years and those against whom the maximum punishment can be seven years. “At this juncture, I am opposing the bail pleas of accused no 3 (Chandolia) and accused no 4 (Balwa),” he said. The court will pronounce the order on Balwa and Chandolia on November 3.
