HYDERABAD: The Human Rights Forum has demanded that a case under Section 302 of the IPC (homicide) be registered against the security personnel responsible for killing of the CPI (Maoist) functionary Mallojula Koteswara Rao alias Kishenji in an alleged encounter near Burisole village in West Midnapur district in West Bengal on November 24.In a statement here on Saturday, HRF state president S Jeevan Kumar and general secretary VS Krishna said that the version of the CRPF and West Bengal Counter Insurgency Force officials that Kishenji died in an exchange of fire cannot simply be accepted at the face value. Every such incident must be registered as a crime under Section 302 of the IPC against those who took part in the encounter and the police personnel concerned have to be put on trial for culpable homicide amounting to murder. The final decision on whether a genuine encounter did take place and life has been taken in permissible circumstances that would exonerate the police has to be taken by a competent court and not by the police themselves, the statement said.The HRF leaders pointed out that the investigation in the case must not be done by the West Bengal police but by an independent agency. It must be handed over to either the CBI or a truly independent criminal investigation team under the aegis of the National Human Rights Commission.
