Justice A K Tripathi passed the order while hearing a petition filed.

Patna: The Patna High Court on Saturday asked the CBI and the Centre to file their replies within six weeks on a petition seeking CBI probe into the killing of a youth from Bihar in an alleged fake encounter in Mumbai last year.

Justice Ajay Kumar Tripathi passed the order while hearing a petition filed by Kundan Prasad Singh, the father of victim Rahul Raj, seeking CBI probe into the death of his son in an alleged fake encounter on October 27, 2008.

The court also issued notices to the Maharashtra Government and the Mumbai police seeking to know their respective stands with respect to the petition within six weeks of receiving it.

The notices were issued to both as their counsels were not present in the court at the time of hearing.

Singh, in his petition, had also contended that the Maharashtra Government had failed to provide forensic report and other documents relating to the killing of Rahul Raj despite repeated requests to the Chief Minister and the Mumbai Police Commissioner.

Citing various media reports, Singh had alleged that his son was shot from close range and described it as the "handiwork" of the Mumbai police.

The hearing in the case is likely to resume after six weeks.
