The Madras High Court has refused to quash an order dated April 25 this year, of the Registrar-General of the Madras High Court, discontinuing the services of three persons, who held the post of presiding officers of the Fast Track Courts (FTCs).
In TN, 49 FT courts were constituted under the centrally funded scheme in 2002. For 15 FT courts, 15 advocates had been directly appointed as judges on ad hoc basis. However, the Central government withdrew the scheme and stopped funding to the courts. the services of three FTC judges — P Radha, A S Hassina and G Savithri — were discontinued. Challenging this, the trio moved the High Court.
Representing the Registrar-General of the Madras High Court, advocate R Suresh Kumar submitted that since the petitioners were appointed on ad hoc basis of contract, they could be removed at any point of time. Accepting Kumar’s submissions, a division bench consisting of N Paul Vasanthakumar and S Manikumar said that the FTC judges could not function after redesignation of the courts as Additional District Sessions Courts, and therefore the necessity arose to discontinue and relieve them from the posts.
